Distance Selling Agreement
Article 1 - SUBJECT OF THE CONTRACT
This contract is the Distance Sales Contract between Aya Studio Textile General Partnership and the Customer, regarding the sale and delivery of the product whose features and sales price are specified below in accordance with the provisions of the Regulation on the Principles and Procedures for Distance Contracts Application of the Consumer Protection Law No. 6502.
Article 2 - SELLER AND BUYER INFORMATIONSELLER INFORMATION

BUYER INFORMATION
All members: All buyers who become members of the company's e-commerce store at the address ............ and make purchases.
(hereinafter referred to as "BUYER" or "CUSTOMER")
Article 3 - SUBJECT OF THE CONTRACT AND PRODUCT INFORMATION
The type, quantity, brand/model, color, quantity, sales price, and payment method of the product/service are as specified on the website, and these promises may change without notice to the buyer.
Article 4 - GENERAL PROVISIONS
4.1 The BUYER declares and undertakes that they have read and informed themselves about the basic characteristics of the product specified in Article 3, the sales price, and the payment method, and has given the necessary confirmation in electronic environment.
4.2 The product subject to the contract is delivered to the BUYER or the person or organization at the address indicated by the BUYER within the period specified in the preliminary information depending on the distance of the BUYER's place of residence for each product, provided that it does not exceed the legal 30 (thirty) day period.
4.3 The SELLER shall not be held responsible for the non-acceptance of the delivery by the person or organization to whom the product is to be delivered, due to the delivery of the product to a different person or organization other than the BUYER.
4.4 The SELLER is responsible for delivering the product subject to the contract in sound, complete, complying with the specified qualifications in the order, along with the warranty documents and user manuals, if any.
4.5 It is a condition for the delivery of the product that this contract has been approved electronically and that the sales price has been fully and unconditionally paid by the BUYER through the payment method preferred by the BUYER. If, for any reason, the product price is not paid or cancelled in the bank records, the SELLER is considered relieved of the obligation to deliver the product.
4.6 If the credit card belonging to the BUYER is used unauthorized or unlawfully by unauthorized persons for reasons not caused by the BUYER after the delivery of the product, the BUYER or the person or institution to whom the delivery is made must send the product to the SELLER within 3 (three) business days. In such a case, the shipping costs shall be borne by the BUYER.
4.7 If the SELLER cannot deliver the product subject to the contract within the specified period due to extraordinary circumstances such as force majeure or adverse weather conditions preventing transportation, the SELLER shall notify the BUYER of the situation. In this case, the BUYER may cancel the order, replace the contract product with its equivalent if any, or extend the delivery period until the impediment is removed. If the BUYER cancels the order, the SELLER shall contact the relevant bank for the cancellation of the BUYER's credit card receipt and the refund of the relevant amount to the BUYER's account within 7 (seven) days, and the transaction shall be notified to the BUYER by e-mail. In such a case, the SELLER shall not be held responsible for any delays caused by the relevant bank.
4.8 If the product delivered to the person or institution to whom the BUYER wants the delivery to be made is defective or faulty, the relevant product or products shall be sent to the SELLER within 7 (seven) days from the date of delivery to the BUYER, and the shipping costs shall be covered by the SELLER. In such a case, the BUYER must send the product they have received to the relevant service center after the expiration of the 7 (seven) day period.
Article 6 - PRODUCT RETURN CONDITIONS
In case the product purchased through our website is found to be defective, you must contact us through the support and/or contact section on our website within 7 (seven) days from the date of delivery.
Following this information, the defective product that you will deliver to us through the cargo company will be replaced after an examination determines that it is defective. If the defect in the ordered product is caused by customer usage or if the product has been used within the 7 (seven) day period, the return and exchange of the product will not be possible. The application of the provisions of the Consumer Protection Law No. 6502 on product returns and exchanges is fundamental.
Article 7 - COMPETENT COURT
In the application of this contract, Consumer Arbitration Boards and Istanbul Duty Consumer Courts are authorized for products up to the value declared by the Ministry of Industry and Commerce of the Republic of Turkey.
By approving the order electronically, the BUYER explicitly accepts, declares, and undertakes all the provisions of this contract.
